GENERAL TERMS AND CONDITIONS OF SALE
RETURN POLICY
Sensitized Material
No sensitized material including all films, photographic papers and Polaroid film may be returned.
Special Order Items
Special order items (non-stocking items), require customer name, address, phone number and credit card number for single orders of $250.00 or less (card not billed until order is shipped) and a 25% non-refundable deposit on single orders over $250.00. A 25% restocking fee for all single order items under $250.00 will be charged that are returned or not picked up within 30 days.
New Equipment
New equipment purchased from Pro Photo Supply, Inc. may be returned with no restock charge within 30 calendar days of purchase if the following conditions are met:
- Equipment is in as-new condition
- Returned with receipt
- Original box and packaging materials are included
- Warranty cards or other documents normally filled by a new owner are returned w/o being filled out
Equipment returned within 30 calendar days of purchase without receipt or original box and packing materials or warranty cards, are subject to a 15% restocking charge.
Equipment returned after 30 calendar days from purchase will not be accepted, except as used equipment.
Digital Imaging Equipment
Digital imaging equipment purchased from Pro Photo Supply, Inc. may be returned with no restock charge within 15 calendar days of purchase if the following conditions are met:
- Equipment is in as-new condition
- Returned with receipt
- Original box and packaging materials are included
- Warranty cards or other documents normally filled by a new owner are returned w/o being filled out
- Equipment such as printers will be refunded less the cost of installed toners or inkjet cartridges normally needed with the printer
- Software cannot be returned if the seal has been broken
Digital imaging equipment returned within 15 calendar days of purchase without receipt or original box and packaging materials or warranty cards, are subject to a 15% restocking charge.
Digital imaging equipment returned after 15 calendar days from purchase will not be accepted, except as used equipment.
Used Equipment
Used equipment purchased from Pro Photo Supply, Inc. may be returned for full credit if any mechanical or optical problems are discovered by the customer. The period of time for return of consigned equipment (99 number) is 10 calendar days. The period of time for return of equipment owned by Pro Photo Supply, Inc. (88 number) is 30 calendar days.
WARRANTIES
Most merchandise sold by Pro Photo Supply, Inc. comes with a limited warranty provided by the manufacturer. Computer equipment and software programs may also include a software license between the manufacturer and the customer.
As between the Customer and Pro Photo Supply, Inc. all merchandise is sold AS IS, without warranty. Pro Photo Supply, Inc. makes no warranties of any kind, express or implied, including any warranty of merchantability or fitness for a particular purpose, with regard to the merchandise identified on the reverse hereof.
Please refer to the manufacturer’s warranty included with the merchandise to determine the remedies available in the event of a defect in materials or workmanship. A copy of the applicable warranty is available for inspection prior to the sale upon request.
LIMITATION OF WARRANTY
Pro Photo Supply, Inc. shall have no liability to customer or any other person or entity with respect to any liability, loss or damage arising out of or connected with the sale including but not limited to, any claim for incidental or consequential damages.
COST AND EXPENSES OF COLLECTION
In the event that the Customer fails to make full payment for the products and/or services provided by Pro Photo Supply, Inc. in the manner and within the time specified by Pro Photo Supply, Inc., Customer shall be liable to Pro Photo Supply, Inc. for payment of all costs and expenses incurred by Pro Photo Supply, Inc. in seeking collection of the amounts owed by the Customer, including but not limited to the costs of collection agencies and reasonable attorneys’ fees incurred by Pro Photo Supply, Inc.
GENERAL
These Terms and Conditions and the sales contract formed between the parties shall be construed and enforced in accordance with the laws of the State of Oregon (without giving effect to its rules of conflict of laws).
